Legal heir certificate or surviving member certificate is an important document which is issued by the Tehsildars of the respective Tehsil to the surviving member of the deceased person. Legal heir certificate is used to establish the relationship between the heirs and deceased for claims related to pension, assets, provident fund or other benefits from the Government. Reason for Obtaining Legal Heir Certificate

Legal heir certificate is often required for transferring of a deceased person’s property. The surviving members of a deceased person’s family can claim for related to pension, insurance, administrative or service advantages, retirement benefits of the government offices, government works and also can require the settlements of property using a legal heir certificate.

Eligibility Criteria

The respective persons are eligible to apply for legal heir certificate in Andaman and Nicobar:

  • Wife of the deceased person.
  • Son or daughter of the deceased person.
  • Father or mother of the deceased person.
  • Sibling of the deceased person.

Applicable Government Fee

The applicant can apply for legal heir certificate in Union territory of Andaman and Nicobar by without remitting any fee for the application copy of legal heir certificate.

Concerned Authority for Certified Copy

The concerned authority who is responsible for issuing the Legal heir certificate is Tehsildar of the respective Tehsil.

Documents Required

The required documents are to be submitted along with the application form of the legal heir.

  • Death Certificate of the deceased person.
  • Affidavit copy relating the details of surviving descendants of the deceased person.
  • Proof of residence like Family Identity Card.
  • Identity proof such as Electoral Photo, Identity card, Islanders Identity Card.
  • Copy of Passport.
  • Local certificate.
  • Birth certificate of all the Children.
  • Legal heir relating to deceased.

Application Procedure – Offline

To apply for a legal heir certificate in Andaman and Nicobar, follow the steps below:

Step 1: One needs to approach the District Tehsildar office for obtaining an application form for a legal heir certificate.

Step 2: Then the duly filled application form has to be submitted along with the prescribed documents to the concerned authority.

Step 3: On submission, the applicant will be provided with an acknowledgement slip with the help of it the applicant can obtain a legal heir certificate.

Application Procedure – Online

The applicant can obtain a legal heir certificate online by following the below-mentioned steps:

Step 1: Visit Official Website

Visit the official website of the Andaman and Nicobar government.

Step 2: Select Useful Service

Click on “useful service” which is displayed on the homepage of the portal.

Step 3: Choose from the List of Online Service

On the next page, select click here to view the list of online services option.

Step 4: Register for Creating Account

The applicant has to register to login into the link for applying legal heir certificate.

Step 5: Fill the Details

The user has to create an account by entering the required details such as

  • User details.
  • Contact details.
  • User Address
  • Identity proof details.
  • Bank details.
  • Other information.

Step 6: Select Create Account

Click on the “create account” button after entering the details.

Step 7: Provide Log in Details

Now the user has to log in with the email id and password.


Step 8: List of Online Service

Then the list of online service will be displayed on the screen, select the application for Family details/legal heir certificate.


Step 9: Application Form

The application form for the legal heir certificate will open up on the next screen.

Step 10: Complete the Details

Fill the application with the required details and attach the prescribed documents along with it.

Step 11: Submit the Form

Click on the “Submit” button following the details entered in the application form.

Step 12: Acknowledgement Slip

Upon submission, the applicant will receive acknowledgement slip as the confirmation of submission.

Note: After verification, the applicant can obtain a legal heir certificate from the concerned authority of District Tehsildar office with the help of acknowledgement slip.

Processing Time

The applicant can collect the legal heir certificate within 14 working days from the date of application.

Validity of Legal Heir Certificate

The legal heir certificate is valid for the entire lifetime, and hence there is no need for renewal.
