In the state of Bihar, an occupancy certificate is an essential document officially certifying that the construction of a building complies with the approved plans. The Department of Urban Development and Housing which regulates under the Government of Bihar issues occupancy certificate only if the constructed building is in the appropriate condition for residency. In this article, we look at the procedure for obtaining the Bihar occupancy certificate in detail.

Bihar Building Bye-Laws, 2013

As per the provisions of the Bihar Building Bye-Laws 2013, the applicant has to apply in the respective application form after the completion of the building for the issuance of the occupancy certificate. The authorised officer after inspection may issue or refuse occupancy within thirty days from the date of application.

Upon termination of the construction, the builder or the owner of the building has to request for the Completion Certificate to the local municipal authority.

If building completion is as per the building approval form and if it satisfies other building criteria such as the distance from the highway, the height of the construction, fixation of rainwater harvesting system, etc., then the concerned authority will issue the Completion Certificate.

Occupancy Certificate

Once the applicant gets the Completion Certificate, they have to apply for an Occupancy Certificate from the local municipal authority.

Occupancy Certificate indicates that the building has complied with all the necessary building rules and regulations. The local municipal authority or by the department of urban development and housing that grants no objection to occupy the building under the prescribed rules. An Occupancy Certificate is given only once the construction has been completed in all aspects.

Applicable Fee

For the Occupancy Certificate in Bihar, the applicant has to remit a processing fee of Rs.1000.

Documents Required

While submitting the application, produce the following documents along with the application form:

  • Notice of Completion in the prescribed format.
  • Three copies of completed building plans.
  • Record of Rights relating to ownership.
  • Copy of the approved plan and approval letter.
  • Certificate of the establishment for fire safety appliances by the nominated authority wherever applicable.
  • Evidence of the effect of all public utility services, and in particular, sewerage, drainage, water supply, and electricity has been linked to the primary public utility system.

Offline Application Procedure

To apply for Bihar Occupancy Certificate, follow the steps specified here.

Step 1: The applicant has to approach the office of the designated officer of the planning authority/ chief municipal officer of the respective municipality to collect the application form for occupancy certificate.

Step 2: Fill the application with required details and attach the prescribed documents.

Step 3: Submit the duly filled application form with all the documents to the concerned authority at the same office.

Step 4: Upon submission of application, the applicant needs to make payment by generating a challan.

Step 5: After submitting the challan make the payment, the applicant will get a message on the registered mobile number and email ID about the successful payment.

Step 6: After verification/ inspection of the documents, the applicant can collect the occupancy certificate.

Online Application Procedure

The  applicant has to follow the steps mentioned below to register for occupancy certificate

Step 1: Visit the official website of the Urban Development and Housing Department.

Step 2: Click on “Occupancy Certificate” option from the menu “Building Permission” which is on the homepage of the portal.

Step 3: On the next screen, the citizen registration form will pop up.

Step 4: The user has to fill the citizen registration form with the required details such as

  • Applicant name
  • Date of birth
  • Email address
  • Mobile number
  • Address details

After entering the details, the applicant has to click on the “Submit” icon.

Step 5: The applicant has to log in as a citizen with the appropriate details like

  • User ID
  • Password
  • Respective municipality details.

Step 6: The application form for occupancy certificate has to fill by the applicant.

Step 7: After entering the details, upload the scanned documents along with the application form.

Step 8: The applicant has to ensure that all the information is filled correctly before final submission.

Step 9:  The applicant has to make a payment to proceed further.

Step 10: Click on “Proceed” icon, which will redirect to the Payment Gateway or Challan generation depending on whether you have selected the online or offline mode of payment.

Step 11: The payment details screen appears, and which mandatory fields must be filled and the “Submit” icon has to be clicked.

Note: The applicant will receive an alert on his registered mobile number and Email ID. Upon a successful transaction, the applicant will accept the application number and transaction reference number.  Once the department authorises the application, the applicant will receive the date for collection of the certificate via SMS and Email. In the case of rejected also, the applicant will be informed via SMS and Email.

Processing Time

The entire process of granting an occupancy certificate will be completed within thirty days from the date of application.

Concerned Authority

Designated Officer of the Planning Authority/Chief Municipal Officer of the respective municipality or a team of officials constituted by the relevant authority is responsible for issuing the occupancy certificate.

Issuance of Occupancy Certificate

A team of officials will visit the site within fifteen days and verify the following aspects as per Bye-laws. After verification of Notice of Completion, Occupancy permission will be issued or refused by the authority within 30 days from the date of application as per the provision of Bye-laws.

Rejection of Occupancy Certificate

In case of not issuing the Occupancy Certificate within the time limit mentioned above, the applicant should submit a notice with an affidavit that the construction is strict as per the approved plans and no dues are pending in development charges or any other form of payment. After submission of such a notice to the concerned authority, an occupancy certificate will be granted within 15 days from the date of notice received.
