Industrial and Trade Acts, 1926

According to Industrial and Trade Acts, any person who enters a trade or any other business such as industries, factories or workplaces in the state has to get prior permission from the concerned authority in advance before the commencement of the activity.

Importance of Trade License

Eligibility Criteria for Andhra Pradesh Trade License

The business owners engaged in a general trading activity within the territorial limit of any municipal corporation is required to get a trade license. The class of trade license differs, and it is based on the nature of the business.

  • Every person intending to construct any factory, workshop or workplace in which it is proposed to employ steam power, water power or other mechanical power or electrical power have to apply for a trade license.
  • A person intending to establish a factory which does not use power also needs to obtain a trade license.
  • For running food establishments such as hotels, eating houses, restaurants, coffee houses, laundries, travel agencies or barber saloon, Andhra Pradesh Trade license is required.

Note: Any unauthorised running of trade is an offence which may result in a substantial penalty and subsequent prosecution.

D&O Trade Licenses

The applicants who wish to start a new trade which involves dealing with dangerous and Offensive substances or material and any such machinery as defined in the rules and regulations of Industrial and Trade Acts have to apply for D&O trade licenses at the respective Urban Local Bodies.

The Health and Revenue section of the ULB deal with the issue of licenses and the following are the key processes which are involved in the issue of trade licenses.

Licensing Authority

The Health and Revenue section of the respective Urban Local Bodies deals with the issue of AP trade licenses. The Chief Medical Officer of Health at Head Office and Assistant Medical Officers of Health, Zone No. I to VI and Medical Officer of Health, Visakhapatnam are vested with the power to issue Andhra Pradesh trade licenses.

Validity

Andhra Pradesh trade license is valid for one year from the date of its issue. The official year for D&O Trade licenses in Andhra Pradesh is from April 1st to March 31st.

Andhra Pradesh Trade License – Renewal

Irrespective of the time of the issue of AP trade license, the license will be valid up to March 31st of every year. The Andhra Pradesh trade license holders must apply for renewal of license between Jan 1st to February end.

Every application for any license or its renewal under this needs to be made the earliest day on which such license expires.

Time Frame

For processing the Andhra Pradesh Trade License, the following SLA is fixed.

Applicable Fee

Fee for Andhra Pradesh Trade License will be varied as per the trade type. On submission of application, the fee for corresponding trade will be notified to the applicant.

Documents Required

No documents are mandated to attach with trade license application. Some of the documents are required at time of post verification.

  • Legal Occupancy Certificate

Note: Depending on the trade type such as Industry / Workshop / Machinery/ Factory, the applicant must obtain the NOC for installing the equipment before starting the trades.

Applying For Andhra Pradesh Trade License

Trade license applications can be submitted through three modes as given below:

  • Puraseva Centers of ULB
  • Mee-Seva Centres
  • Online CDMA Web portal or ULB Web portal

Applying for Andhra Pradesh Trade License through MeeSeva Franchise

Procedure to obtain Andhra Pradesh trade license through MeeSeva Franchise is explained in detail below.

Approach MeeSeva Franchise

Step 1: Applicant needs to approach the nearest MeeSeva Franchise, to apply for the trade license.

Submit an Application

 Step 2:  The applicant needs to apply in the prescribed format for obtaining an Andhra Pradesh trade license at the MeeSeva Franchise. The application form for obtaining Andhra Pradesh trade license is enclosed here.

TradeLicense

Provide the following details in the application form:

  • Trade owner details such as name, father name, Address, Owner SSID number, email ID, phone number
  • Trade Details such as Trade Name, type, Address, license required date
  • Nature of trade ownership such as Government, ULB, Private
  • Payment details

Note: Mention the mode of delivery of extract of ROR-1B.

Step 3: The request for AP trade license will be forwarded online to the concerned ULB.

Note: MeeSeva centre service operator will issue a receipt with the trade license application number. ROR-1B application number will also be sent to the registered mail ID and mobile number. Keep it safe for future reference.

Application Processing

Step 4: The concerned authority, Chief Medical Officer of Health of respective ULB will process trade license request online.

Step 5: After downloading all verification and proceeding documents, the health inspector will take action for issuing trade license.

Get Trade License

Once the concerned authority approves the request, trade license will be dispatched through courier from franchisee to the applicant’s address if Delivery Type is Speed Post Local or Non-Local.

If the Delivery type is Manual, then the citizen can collect the trade license from MeeSeva franchisee where he/she applied for the Certificate.

Applying through Puraseva Centers of ULB

The procedure to apply for Andhra Pradesh trade license through Puraseva centres of ULB is same as procedure explained above. The applicant needs to visit respective Puraseva Centers of ULB and get trade license from there.

Applying – Online CDMA

For applying for trade license through CDMA portal applicant can follow the procedure given below.

Step 1: Access the home page of Commissioner and Director of Municipal Administration (CDMA) portal.

Step 2: From the home page select online service option, list of service will be displayed select the trade license and then file your new trade license option.

Step 3: In the new page, the applicant needs to select the corporation or municipality from the drop-down menu where the trade is intended to be established.

Step 4: By clicking on the submit button, the application form will be displayed.

Provide Details

Step 5: Provide details in the application form such as trade owner details, trade location details, trade details and processing details. After entering information, click on save.

Upload Documents

Step 6: Upload all supporting documents as mentioned above and click on save.

Step 7: After successful submission of application, an acknowledgement number (slip) will be generated along with the trade license fee payment to be made.

Note: The acknowledgement number is to be saved for making payment and tracking application.

Pay Fee

Payment can be made online at the CMDA portal by using acknowledgement number the amount to be paid can be retrieved.

After successful payment, Provisional License will be generated.

Issue of Provisional License

After payment of the applicable license fee, provisional License certificate can be downloaded from the ULB Portal or CDMA.

Post Verification Process

Depending on the type of trade, the processing of the application will start. The sanitary inspector will inspect the proposed trade premises and submit his field verification details to the commissioner.

Based on the remarks received from the sanitary inspector, the commissioner decides whether the license is to be granted or not. If he grants permission, Andhra Pradesh license will be given to the applicant.

Application Status

To track the trade application details, the applicant needs to access the CDMA portal. From the online service, option select know your application status option.

By selecting District and Municipality from the drop-down menu and clicking on submit option, the new will appear.

In the new page select trade license option from the menu and provide Identifier number, the application status will be displayed.

Download Trade License

Once the status is complete, the applicant can download trade license from CDMA portal. Select the option download trade license from the menu.

By selecting District and Municipality from the drop-down menu and clicking on submit option, the new will appear.

In the new page provide the license number, mobile number, trader owner name and application number. The Andhra Pradesh Trade license can be downloaded by clicking on the search option.

Andhra Pradesh Trade License Renewal Procedure

Every application for any license or permission or its renewal under this rules or bye-laws needs to be made not less than thirty days and not more than ninety days before the earliest day on which such license expires. The applicant has to apply for license renewal online through CDMA portal.

From the menu select trade license renewal option, and select concerned district and municipality where the trade has been established. In the new page provide following details.

  • License Number
  • Application No.
  • Mobile No.
  • Trade Owner Name

By clicking on the search option, the trade license details will be displayed. Click on the application for renewal.

The application will be forwarded to the concerned authority. After approval, you can download the certificate from the CDMA portal.

Note: The rules and regulations for issue of temporary AP trade licenses to businesses such as crackers shops during Diwali season etc., is also the same as regular license except validity of period and license fee.
