IT Return Filing Forms Released

The Income Tax Department of India has commenced electronic Income Tax Return Filing for the AY 2015-16 by releasing the software for preparing Income Tax Return forms 1 – SAHAJ, 2, 2A and 4S-SUGAM. The filing of income tax return utilizing new tax forms have also been enabled on the the Income Tax Departments E-Filing website.

ITR 1 – SAHAJ Form – Individuals having Income from Salary & Interest

ITR 1 of 1-SAHAJ can be be used by an individual whose total income for the assessment year 2015-16 includes the following components: 

  • Income from Salary/Pension; or
  • Income from One House Property (excluding cases where loss is brought forward from previous years); or
  • Income from Other Sources (excluding winning from Lottery and Income from Race Horses) and does not have any loss under the head.

ITR 1 of 1-SAHAJ should not be used by an individual whose Total Income for the assessment year 2015-16 includes:

  • Income from more than one House Property; or
  • Income from winnings from Lottery or Income from Race Horses; or
  • Income under the head “Capital Gains”, e.g., short-term capital gains or long-term capital gains from sale of hose, plot, shares, etc, or
  • Agricultural income in excess of Rs.5000; or
  • Income from Business or Profession; or
  • Loss under the head “Income from other sources; or
  • Person claiming relief under Section 90 and/or Section 91; or
  • Any resident having any assets (including financial interest in any entity) located outside India or
  • Any resident having income from any source outside India.

Form ITR 2 – Individuals & HUFs not having Income from Business or Profession

ITR 2 is to be used by an Individual or a Hindu Undivided Family (HUF) whose total income for the assessment year 2015-16 includes only:

  • Income from salary or pension; or
  • Income from house property; or
  • Income from capital gains; or
  • Income from other sources (including winning from lottery and income from race horses).

ITR 2 should not be used by an individual or HUF whose total income for assessment year 2015-16 includes income from business or profession.

Form ITR 2A – Individuals and HUFs not having income from Business or Profession and Capital Gains and who do not hold Foreign Assets

ITR 2A Form can be used by individuals and HUFs whose total income for the assessment year 2015-16 includes:

  • Income from salary or pension; or
  • Income from house property; or
  • Income from other sources (including winning from lottery and income from race horses).

ITR 2A Form must not be used by any individual or HUF whose total income for the AY 2015-16 includes:

  • Income from capital gains; or
  • Income from business or profession; or
  • Any claim of relief/deduction under section 90, 90A or 91; or
  • Any resident having any asset (including financial interest in any entity) located outside India or signing authority in any account located outside India; or
  • Any resident having income from any source outside India.

ITR 4S – SUGAM Form- Individuals or HUFs having income from presumptive business

Form ITR 4S – SUGAM is to be used by an individual or HUF whose total income for the AY 2015-16 includes:

  • Business income where such income is computed in accordance with special provisions referred to in section 44AD and 44AE of the Act for computation of business income; or
  • Income from salary or pension; or
  • Income from one house property (excluding cases where loss is brought forward from previous years); or
  • Income from other sources (excluding winning from lottery and income from race horses).

Form ITR 4S – SUGAM should not be used by an individual or HUF having the following types of incomes:

  • Income from more than one house property;
  • Income from winnings from lottery or income from race horses; or
  • Income under the head “Capital gains”; or
  • Agricultural income in excess of Rs.5000; or
  • Income from speculative business and other special incomes; or
  • Income from a profession or income from agency business or income in nature of commission for brokerage; or
  • Person claiming relief of foreign tax paid
  • Any resident having an asset located outside India or signing authority in any account located outside India; or
  • Any resident having income from any source outside India.
