Functionality to Check Misuse Of PAN in GST Registration

Recently, the Goods and Services Tax Network (i.e., GSTN) has introduced a new feature namely ‘‘Functionality To Check Misuse Of PAN’ to address the complaints related to misuse of PAN for obtaining GST registration. Once a complaint is registered, it will be sent to the concerned jurisdictional authority where the registration is claimed to be fraudulently obtained, for necessary inquiry and suitable action. The present article briefly explains the steps to Register complaint on misuse of PAN in GST Registration.

The new function checks the misuses, control the frauds and help officers in inquiry and cancellation of such GST registration.

Process of registering a complaint

The process of registering complaints on misuse of PAN in GST Registration is explained in detail below:

Search the GSTIN based on PAN

Search functionality is provided at the GST Portal to find out whether any GSTIN is issued on a particular PAN or not.

  • The taxpayer needs to access the GST portal and select Search taxpayer and Search by PAN.

  • The System displays details of the GST registration available on that PAN.

  • In case, no registration is available on that PAN, then the message will be shown as “No records found”.

Register Complaint

Any person aggrieved of having his PAN misused, may register a complaint at GST Portal directly or through an authorized representative. He/she needs to search the GSTIN based on PAN. If any registration not obtained by him is displayed, then it is to be reported to the jurisdictional officer. By selecting the respective misused GSTIN, the complaint will be forwarded to the jurisdictional officer.

Provide Details

On clicking of “Report” button following Pop-up will be displayed.

  • In the case of Individual PAN (Where the 4th letter in PAN is “P”) Legal Name as per PAN will be auto-populated.
  • While registering the complaint, the complainant has to provide the e-mail and Mobile Number for validation and the other information like D.O.B. and Address, etc. mandatorily.
  • For the GSTIN registered under the category, other than Proprietor, complainants have to enter their personal details, which would be followed by Aadhaar Authentication.

Generation of ARN

Once the request is submitted, ARN will be generated. In case multiple GSTNs are selected for such complaints, ARN for each GSTIN shall be generated separately and will be assigned to their respective jurisdictional officers on their dashboard for further necessary action.

Complaints Processing By Competent Authorities

Once the complaints are registered, they will be made available to the competent authorities at their dashboard under  “Application for Reporting Fake GSTIN’s”  tab for further necessary action.

Note: The officers shall have a new role of “PAN Vigilance officer” in the Back Office for this purpose.

Check Status of Complaint

The Complainant can further track the status of the application through track ARN at GST Portal pre-login.

The taxpayer needs to access the official website of GST. From the homepage, click on the service option.

By clicking on the Track Application Status option, the link will redirect to the new page.

Select the Module as Registration and provide the ARN number. By clicking on the search option, the Complainant can further track the status of the application.
