How to Register your Trademark in IPIndia?

In today’s competitive business environment, establishing a unique and recognisable brand is essential for long-term success. Trademark registration in India plays an important role in safeguarding your brand identity, granting you exclusive rights to use your brand name or logo, and protecting your business from infringement or misuse by others. By securing a registered trademark, you not only build trust and credibility with consumers but also gain a valuable legal asset that sets your business apart and supports future growth in the marketplace. Let’s get into the step-by-step process of registering your trademark in IPIndia.

Step 1: Obtain a Digital Signature

Get a Class II or III digital signature from any Indian Certifying Authority and install it on your computer. This is mandatory for e-filing your trademark application.

Step 2: Trademark Classification

Identify the correct trademark class for your goods or services using the NICE Classification (Classes 1–34 for goods, 35–45 for services).

Step 3: Conduct a Trademark Search

Search the IPIndia trademark database to ensure your proposed mark is unique and not already registered or pending. This reduces the risk of objections later.

Step 4: Prepare Required Documents

Documents typically needed:

  • Applicant’s identity proof (Aadhar, PAN, etc.)

  • Business registration certificate (if applicable)

  • Soft copy of the trademark/logo

  • Power of Attorney (Form TM-48, if filed by an agent.

  • Proof of claim for prior use (if any).

Step 5. File the Trademark Application (Form TM-A)

Choose between manual filing (at the appropriate Trade Marks Registry office) or e-filing (recommended for instant acknowledgment).

  • Fill in applicant details, description of goods/services, and upload required documents.

  • Pay the prescribed fee.

Step 6: Application Examination

The Registrar examines your application for compliance and checks for conflicts or legal issues. If objections arise, you may need to respond or attend a hearing.

Step 7: Publication in Trademark Journal

If accepted, your trademark is published in the Trademark Journal for public opposition. If no opposition is filed within 4 months, the process moves forward.

Step 8: Registration Certificate

If unopposed (or opposition is resolved), you receive the registration certificate, and your trademark is officially registered for 10 years.
