Documents Required for Trademark Registration

Trademark registration is a crucial step for any business seeking to protect its brand identity. Whether you're running a startup, a partnership firm, a private limited company, or an LLP, registering your trademark gives you exclusive rights to use your brand name or logo and helps prevent unauthorised use by others. To complete the registration process smoothly, it's essential to gather the necessary documentation in advance. Here's a detailed guide on the documents required for trademark registration in India.

Initial Details Required for Trademark Application

To initiate your trademark registration online, gather the following basic details:

  • Applicant’s Name – Full name of the individual or entity applying.
  • Business Type – Specify the structure: Individual, Proprietor, Company, LLP, Partnership, or Trust.
  • Business Activities – Brief description of goods or services offered.
  • Trademark to be Registered – The exact wordmark, logo, or slogan.
  • Registered Address – Official business or residential address.

Documents Required for Trademark Registration

Here is the complete checklist of documents required for trademark registration in India. Make sure you have these documents ready to ensure a smooth and hassle-free application process:

1. Incorporation Certificate (Company or LLP)

If the trademark is being registered in the name of a company or a limited liability partnership (LLP), you must submit the Certificate of Incorporation. This document establishes the legal identity of the business entity and confirms its registration with the Ministry of Corporate Affairs (MCA).

2. Partnership Deed (For Partnership Firms)

For partnership firms applying for trademark registration, the Partnership Deed must be submitted. This document defines the terms and responsibilities of the partners and confirms the legal existence of the firm.

3. PAN Card of the Authorised Signatory

The PAN (Permanent Account Number) card of the individual authorised to sign the trademark application is required. This is necessary for identity verification and tax compliance.

4. Aadhaar Card of the Authorised Signatory

Along with the PAN card, the Aadhaar card of the authorised signatory is needed. It helps authenticate the identity of the applicant and enables e-signature verification via Aadhaar-based authentication.

5. Form-48 (Signed by Applicant)

Form-48 is a legal authorization allowing a trademark agent or attorney to file the application on behalf of the applicant. This form must be signed or e-signed using Aadhaar authentication through the E-sign Desk. Without this, the agent cannot proceed with the filing.

6. Trademark Logo (Optional but Recommended)

If you're registering a wordmark, a logo isn't mandatory. However, if your trademark includes a design or logo, you must upload a clear image. It is recommended to upload it in black and white, as this ensures broader protection by covering all color variations of the logo under the trademark registration.

7. MSME/Udyam Registration Certificate (Optional)

If your business is registered as an MSME (Micro, Small, or Medium Enterprise), providing the MSME/Udyam certificate can entitle you to a 50% government fee concession for trademark filing. It is a valuable benefit for startups and small businesses.

8. GST Registration (If Available)

While not mandatory, providing a copy of your GST certificate helps establish the existence and address of the business. It can also be used as a supporting document for verification purposes.

9. User Affidavit

If you have been using the trademark prior to filing the application (i.e., for an already existing brand), a user affidavit is required. This affidavit must state the date of first use and provide supporting evidence like invoices or advertisements.

10. No Objection Certificate (NOC)

If the trademark includes a person’s name or image, or if permission is needed from another party (e.g., for co-owned brands), a No Objection Certificate (NOC) from the concerned person/entity is required.
