
Assam Factory Registration
In Assam, factory registration is mandatory as per the provisions of the Factory Act, 1948. Factory owners must register their premises with the district governing authority before the commencement of business. Prior to issuing a factory license, the approval of the building plan is compulsory for the factory. The Chief Inspector of Labour Commissioner Organisation will grant the factory license after registration. In this article, we take a look at the procedure for Assam factory registration in detail.Applicability for Factory Registration
The below-mentioned factories are expected to request for factory license under the following conditions.- The factory or establishment holds ten or more workers employed with the use of power for manufacturing activities.
- The factory or establishment carries twenty or more workers employed without the use of electricity for manufacturing activities.

Documents Required for Permission of Site Appraisal
The following documents are to be provided for the getting the site approval.- Application to the Site Appraisal Committee specified under Rule 61G(3)(b) (15 copies along with following documents).
- Land Documents (deed of ownership/ lease, indicating Dag No. and Patta No., Total Area, etc.).
- Clearance certificate from State/ Central Govt. under I.F.Act,1927 and E.P.Act,1986.
- No Objection Certificate from Local authority in respect of the location of such factory.
- Site Plan presenting details as indicated in item 3.1(a)-(e) and 3.4 of the application format.
- Flowchart of the buildings and installations, in the proposed site.
- Report of soil test
- Contour Map of the location.
- Copy of detailed Project Report.
- Copy of Proposed Health and Safety Policy.
- Meteorological information relating to the site (ref: Item No. 6.1 to 6.4 of the application format.
- Process flow chart with a brief explanation of the manufacturing process and technology.
- Material Safety Data Sheet in respect of all hazardous substance
- Process Risk/Hazards details (reference: Item No. 11.1 to 11.3 of the application format.).
- On-Site Emergency or Disaster Preparedness Plan and Off-Site Emergency Plan/ Mutual Aid Scheme.
- In case of a partnership firm or other association of individuals, the copy of partnership deed is required.
- In case of a company, the list of directors/ shareholders details are to be present in the articles of association.
Documents Required for Site Plan Approval
The required documents are to be provided for the approval of your site plan.- Three copies of Form No. 1 Prescribed under Rule – 3.
- Process Flow Diagram of plans
- Brief write up on process and technology
- Blueprint of Plans in duplicate as
- Drawn to scale representing the site of the factory and immediate surroundings including adjacent buildings and other structures, roads drains etc.
- Drawn to scale representing the plan, elevation and constant cross-section of the various buildings, including all appropriate details representing natural lighting, ventilation and the method of escape in case of fire. The plan shall also clearly indicate the position of the plant and machinery, aisles, electrical panels, switches, motors with rated H.P. etc. and passageways.
- No Objection Certificate from local authorities in respect of non- agricultural land, forest, wetland, hills, sanctuaries etc. (SDG – 15, Assam vision 2030).
- Clearance certificate from the controller of explosives, if any.
- The exact certified copy of the executed deed of ownership/ lease/ allotment of land/ building/ flat etc.
Documents Required for Registration and Licensing
The required documents are to be provided along with the application form of factory registration and licensing.- Three copies of Form No. 2 prescribed under Rule – 4 and Rule – 7.
- Treasury Receipt in original, showing the deposit of appropriate fees as per schedule A, B or C [Rule 5 – (1)]
- Executed Partnership deed in case of a firm or any other association of individual and nomination of occupier/ licensee for the Act.
- Details of Association and Memorandum of Incorporation in case of a company of the Indian Companies Act 1956, and Directors/ Shareholders and resolution of B.O.D.’s list for the nomination of occupiers for the Act.
- Appointment letter in regard of Chief Administrative head of the unit from the concerned Ministry/ Board in case of Govt. / Local Fund as an occupier for the Act.
Online Factory Registration Procedure
To factory registration in Assam, follow the steps given below. Before registering for the factory, the applicant has to apply for a site appraisal and site plan approval online.Application Procedure for Site Appraisal
Step 1: Please visit the official portal homepage of the Labour and Welfare Inspectorate of Factories, Assam. Step 2: Click on “Online Services” tab on the home screen of the page. Application Procedure for Site Approval
Step 1: To apply for Application for Permission to Construct, Extend or take into use any Building as a Factory - Form I click on Apply button under apply online option. Step 2: You need to provide your username and password to login into the portal. Step 3: You need to select the type of business from the following options and then click on the “Submit” button. Step 4: The common application form regarding your business will appear then the user needs to fill the form with the details like enterprise details, applicant details, other details and upload section and click on “save and next” button to proceed further. Step 5: Then the applicant has to fill up the application form-1 for site plan approval with the appropriate details and then upload the required documents. Step 6: Then the applicant has to make the Payment can be made done through either offline or online mode. Step 7: you can make payment offline through the generating the challan and go to the treasury for approval and pay in the designated bank and upload the copy of the payment receipt in the online form and submit the same. Step 8: To make payment online click on Pay online button and select your payment mode net banking, debit card or credit card. Step 9: Once payment details are submitted online an acknowledgement number will be generated with the Unquie application identification number. This Unquie application identification number will be used for further reference and for tracking your form to know your application status. Note: The submitted documents and drawings will be evaluated and processed. If the approval is made then one set of approved pictures will be issued for construction of buildings, installation of types of machinery, etc. as per plans and specification. If approval is rejected, fresh/corrected documents will be asked for resubmission.Application procedure for Factory License

Renewal of License
