Trade license is a certificate/ document that permits an entity to carry on the business or trade activities in a particular municipal limit for which it is issued. The provision of a trade license is laid down by the State government to monitor and regulate various trade activities within a city. In Uttar Pradesh, trade license is issued by the respective Municipal Corporations of Uttar Pradesh to traders and establishments, to monitor and regulate various trade activities at the city level. The regulations under this act apply to a shop or a commercial establishment located within the limits of municipal areas in the state of Uttar Pradesh. This Act has been enacted to consolidate and amend the law regulating the conditions of service of employees working in shops and in commercial establishments. Every employer is required to make application for Registration or Renewal of his Shop or Commercial Establishment within 30 days of commencement of business. This Act is one of the mandatory requirements of all businesses which operate from an establishment or shop. If any changes made in the closure of establishment, then it needs to be initiated to the concerned authority within 15 days.Business types that require a Trade License
This Act is applicable to all shops, and commercial establishments located in the state of Uttar Pradesh except those exempted by the state government. All commercial establishments that fall under the following categories must obtain trade license:- Food establishment license: Hotels, restaurants, canteen, food stall, bakeries, the sale of vegetables and meat etc.
- Industries license: An establishment or administrative service in which persons employed or mainly engaged in factories, power looms, flour mills, cyber cafe, etc.
- DOT License: Offensive and dangerous trades such as candle manufacturer, cracker manufacturer, barber shop, etc.
- Shop license: Manufacturing, exchange or storage of any activity/commodity.
Requirement to Obtain Trade License
The government has made it mandatory for one to obtain trade license to ensure that the person is not carrying out unethical business practices and is following relevant rules, safety measures and guidelines. A licensed business protects its owners against certain types of liability. If damage or injury occurs, personal finances would not be at stake in any settlement. The various types of trade licenses offer different levels of protection. In case if a person operates or runs a business without a trade license, then the government can impose fine and penalty for such companies that may also lead in the closure of the business.List of Required Documents
The following information or documents/records are to be furnished at the time of submitting the application form for obtaining Uttar Pradesh trade license.- Address Proof and Identity Proof – Individual.
- Affidavit
- Certificate of Incorporation, MOA and AOA of the company.
- Cancelled Cheque and Bank Statement.
- Certificate of Incorporation, MOA and AOA of the company.
- IT return and Property Tax Receipt
- Legal Occupancy document proof of the establishment/unit or allotment letter of the government agency.
- Documentary proof of establishment of trade.
- Lease Deed of the constitution.
- Documentary proof regarding the non-existence of unauthorised construction.
- NOC (No Objection Certificate) from the land-owning agency.
- Address Proof and Identity Proof
- Original License copy
- Old G-8 receipt
- Application for renewal of a license
- First Information Report (FIR)
- Indemnity Bond in the prescribed format.
Application Procedure for Trade License – Offline Procedure
In Uttar Pradesh, the applicants must follow the following steps to apply for trade license by submitting the application form online. Approach the Municipal Cooperation Step 1: Firstly, the applicant has to visit the licensing department ranging from a particular municipal limit. Step 2: The applicant has to make a request with the executive for applying for a trade license. Application Procedure for Trade License - Online Method
In Uttar Pradesh, the applicants must follow the following steps to apply for the trade license by submitting the application form online. Visit the e-NagarSewa Portal Step 1: The applicants have to go to the official e-NagarSewa Portal of Uttar Pradesh to apply for the Trade License online. Renewal of Trade License
Applicants can select the Renew License link from the official portal by clicking on its ‘Renewal’ link and can apply for the Renewal of trade license. Validity Period of Trade License
Trade License Certificate would be valid for three years from the date of issue. Hence, it has to be renewed after three years by payment of license fee for such period.Check/ Track Status of Application
To know the status of your application, go to the official e-NagarSewa portal. You have to select the Application Status tab available on the site. Enter your application number and have to enter the Image text. Click on the Submit button to view the current status of your application. Download Trade License
If the concerned authority has approved the verified application form, you will receive a notification on your registered mobile number. The trade license details will be updated in the portal of the concerned state’s records. Log into the official portal and enter the Certificate number along with the image text shown.
