Uttar Pradesh Society Registration

Society is an organized group of people with an aim and objective of providing non-profitable service. Societies Registration (Uttar Pradesh Amendment) Act, 1976, lays down the procedure for society registration and operation in Uttar Pradesh. Society can be registered with the concerned Registrar in the district in which the society is intended to be established. After registration, the society will have legal recognition. In this article, we look at the procedure for Uttar Pradesh Society registration in detail.

Societies Registration (Uttar Pradesh Amendment) Act, 1976

As per the provision of Societies Registration (Uttar Pradesh Amendment) Act, 1976, Society is considered as an association of individuals united together by agreement to deliberate, determine and act jointly for the following purposes:

  • Literature
  • Science or the fine arts
  • Reading rooms for general use among the member
  • Promotion of Khadi and Village industry
  • Instruction or diffusion of useful knowledge or political education.
  • Works of art, the collection of natural history
  • Military orphan funds
  • Instruction or diffusion of useful knowledge or political education
  • Foundation or maintenance or libraries
  • Mechanical and philosophical inventions, instruments or designs
  • Public museums and galleries of paintings
  • Works of art, the collection of natural history

Minimum of seven persons, including office-bearer who have attained the age of eighteen years can register a society in Uttar Pradesh.

Acceptability of Names for Society

The Emblems and Names ( Prevention of Improper Use Act, 1950) suggest that the place or societies should not have the same names. If the name is registered or prohibited by Central or State Government are also not allowed for society name registration. Besides, Government emblems and names, University or name of Indian Institute also cannot be accepted.

Required Documents

The following things are essential for societies registrations in Uttar Pradesh:

  • Minimum of 7 members including office-bearer
  • Memorandum of Association with the prescribed format
  • Copy of resolution of the first meeting
  • Address Proof of the location of the society office
  • NOC from the owner of Society Office is rented
  • Ownership Documents ( Electricity bill, Water bill, House tax receipt)
  • Address proof of all members of the society
  • Latest photo with self-attested
  • Affidavit on Rs. 10 Non-judiciary Stamp Paper, Attested by Notary from the President/Secretary of the Society.
  • Letter application for the registration of society to Deputy Registrar of the concerned district from the Secretary/President of the Society.

Memorandum of Association (MOA)

Memorandum of Association of Society is also as NGO registration in which contains society name, aim and objects, occupations of the members.

Bye-Laws of Society

Bye-Laws are formulated for the following specific purposes and also serve as evidence of Society Registration in Uttar Pradesh.

  • For identifying society such as name and address.
  • Information related to activities of the society.
  • Details of the manner of meetings to be held, quorum, function & responsibilities.
  • Society membership details include admission, eligibility, withdrawal and termination of members.
  • Details of office bearers and their appointment, removal, recall and election.
  • Data’s related to internal matters of the settlement of internal disputes and dissolution of the society.
  • Finances related data’s such as types of funds to be raised and liability of members for the discharge of debts.

Procedure for Society Registration

The State Government of Uttar Pradesh approves the Society Registration through Registrar of Firms and Societies and Chit.

Step 1: To register a society in Uttar Pradesh, submit the application and the affidavit in a prescribed format along with the supporting documents to concerned Registrar.

Step 2: Draft a Memorandum of Association and By-Laws of the Society in duplicate with signatures of at least three members on all the papers. The Memorandum and By-Laws are strictly to be as per the guidelines in Society Registration Act and should be only for the charitable purpose.

Step 3: Then take the address proof of all the members of the society and one of the registered address of the society. Draft a Board Resolution Where all the members had desired to form a society together with the approval of the name of the society.

Step 4: Make an affidavit at Rs.10 Stamp paper saying that the Society name proposed is not used by any other Society and the address of the society is correct. Now, you can proceed with the payment and finish the procedure.
