Key Points of the New Income Tax Bill, 2025
- The new Income Tax Bill 2025, set to be tabled in Parliament on Thursday (13th Feb 2025), marks a historic moment in India’s tax landscape, as it will replace the current year legislation introduced way back in 1961. The bill, once passed, will come into effect from April 1, 2026.
- Aimed at overhauling the nation’s tax system, the bill seeks to eliminate obsolete sections that have accumulated over decades. Its primary objective is to simplify the tax laws, reduce legal disputes and encourage voluntary tax compliance.
- The Income Tax Bill, 2025 comprises 536 sections, higher than 298 sections of the current Income-Tax Act, 1961. The existing law has 14 schedules which will increase to 16 in the new legislation. The number of pages has been reduced substantially to 622 in the new Income tax Bill.
- Under the current system, the Income Tax Department must seek parliamentary approval for various procedural matters, tax schemes and compliance frameworks. As per Clause 533 of the new law, the CBDT will have the authority to establish tax administration rules, implement compliance measures and enforce digital tax monitoring systems without requiring frequent legislative amendments.
- A significant change in the bill is the removal of terms ‘Assessment Year’ and ‘Previous Year’ while introducing a new Term ‘Tax Year’.
- The Bill uses shorter sentences and has been made reader friendly with the use of tables and formulae. Tables have been provided for provisions relating to TDS, presumptive taxation, salaries and deductions for bad debt.
- The Bill mandates the Board to adopt and declare a Charter for Taxpayers and issue such orders, instructions, directions or guidelines to other income-tax authorities as it considers fit for the administration of such Charter. 'Taxpayer's Charter' outlines the rights and obligations of the taxpayers.
- In the new bill all TDS related sections have been brought together under a single clause with simple tables, for ease of understanding.
- The Bill is free from 'explanations or provisos', thereby making it easier to read and comprehend.
- The new bill has omitted redundant sections like those relating to Fringe Benefit Tax.
