ITR Due Date - 31st August: LLPs Need to Know

The Income Tax Return (ITR) filing season is in full swing, and one of the biggest reliefs for taxpayers this year is the extension of the due date for certain non-audit business taxpayers. The due date for filing ITR-5 in eligible non-audit cases is 31 August, providing additional time to complete tax compliance accurately. The revised timeline aims to reduce last-minute filing pressure and improve the quality of return filing.

What is ITR-5?

ITR-5 is the Income Tax Return form meant for entities other than individuals and companies. It is generally applicable to:

  • Limited Liability Partnerships (LLPs)
  • Partnership Firms
  • Association of Persons (AOPs)
  • Body of Individuals (BOIs)
  • Artificial Juridical Persons (AJPs)
  • Estate of Deceased or Insolvent
  • Business Trusts
  • Investment Funds and certain other eligible entities

Companies required to file ITR-6 and charitable trusts filing ITR-7 cannot use ITR-5.

Who Can File ITR-5 by 31 August?

The 31 August due date is applicable to non-audit taxpayers filing ITR-5. If the entity is required to get its accounts audited under the Income Tax Act or any other law, the due date will be different. Taxpayers should first determine whether tax audit provisions are applicable before relying on the extended deadline.

Documents Required Before Filing

Before starting the return filing process, keep the following documents ready:

  • PAN of the entity
  • Aadhaar details of partners or designated partners where applicable
  • Financial statements (Balance Sheet and Profit & Loss Account)
  • Bank account details
  • Form 26AS
  • Annual Information Statement (AIS)
  • Taxpayer Information Summary (TIS)
  • Details of advance tax and self-assessment tax paid
  • TDS and TCS certificates
  • Details of deductions and exemptions claimed

Having these records ready helps avoid errors and reduces the chances of receiving notices from the Income Tax Department.

Why Should You File Before the Due Date?

Timely filing of ITR-5 offers several benefits:

  • Avoids late filing fees and interest where applicable
  • Enables faster processing of tax refunds
  • Maintains better tax compliance records
  • Facilitates easier loan and credit approvals
  • Helps carry forward eligible business losses subject to the Income-tax Act

Common Mistakes to Avoid

Many taxpayers make avoidable errors while filing ITR-5. Some common mistakes include:

  • Choosing the wrong ITR form
  • Mismatch between books of accounts and Form 26AS or AIS
  • Incorrect reporting of partner remuneration or interest
  • Failure to disclose all bank accounts
  • Incorrect claim of deductions
  • Not verifying the return after submission

Reviewing the return carefully before filing can save considerable time and prevent future notices.

Final Thoughts

The extension of the ITR-5 filing due date to 31 August gives eligible taxpayers valuable additional time to prepare an accurate return. LLPs, partnership firms, AOPs, BOIs and other entities covered under ITR-5 should use this opportunity to reconcile their financial records, verify tax credits and complete compliance well before the deadline. Filing early not only avoids last-minute technical issues but also ensures smooth processing of the return and any eligible refund.
